Conservatorships
Conservatorships are established for individuals over the age of 18. There are a few different types of conservatorships, including:
General Conservatorship of the Person — for adults who lack capacity because of physical or mental condition to provide for their own needs for food, clothing, housing, medical care and any other physical needs.
General Conservatorship of an Estate — for those unable to manage their financial resources or to resist fraud and undue influence. If a conservatorship of the estate has been established, the conservator must submit regular accountings to the court detailing the receipts, expenditures and the property on hand.
Limited Conservatorship — Established for individuals that are developmentally disabled. These are usually "of the person" only, but can be "of the person and estate."
Conservatorships and guardianships are established by the Superior Court of California pursuant to provisions of the Probate Code. Once established, a probate conservatorship continues until its termination by the court or the death of the conservatee. The court monitors the conservatorship by sending an investigator from the court on a periodic basis to check that the conservatee is being properly taken care of.
Guardianships
Guardianships are established by the court for individuals under the age of 18.
Guardianships are established "for the person," in which you are responsible to provide food, clothing, housing, schooling, and medical care for the person. Or, they can be established "for the estate," in which you are responsible for protecting and investing the money for the individual minor. No money is to be spent without court authorization. You may also be guardian of both the person and estate.
The establishment of a conservatorship or a guardianship is a technical and labor intensive procedure that often requires a lawyer with legal experience and thorough knowledge of the intricacies of the law and the policies of the court and the county where it is required to be established.
