Why Form a Special Needs Trust?

There are limitations on cash resources and income for disabled individuals who qualify for SSI and Medi-Cal benefits. Typically, an individual will be forced to liquidate or spend down those assets in order to use those programs. However, a Special Needs Trust created by a third party (a parent, relative, or friend) does not disqualify the recipient from receiving benefits.

In addition, in the event your disabled loved one receives funds from a settlement, an inheritance or some other source, there are provisions to petition the court to establish a special needs trust to provide for your loved one and still not disqualify the disabled person from public benefits.

Creating a Special Needs Trust

A Special Needs Trust can be incorporated within your estate plan so that it is created upon the death of both parents or upon the death of a surviving parent or relative, or an Irrevocable Trust can be established during a parent's or relative's lifetime for the benefit of the disabled person.
